In May 2026, the US Justice Department began investigating whether Yale’s undergraduate, law and medical admissions discriminate against white and Asian applicants, in breach of the Supreme Court’s 2023 ban on race-conscious admissions. It has since concluded, partly from gaps in median test scores and grades, that the medical school favoured Black and Hispanic applicants. Faculty groups argue the evidence is statistically weak. The administration has threatened to cut federal funding to universities found in violation.
Recent settlements by other universities have included:
- Payments of $50m–$200m (Columbia, Brown, Northwestern)
- No payment, but new admissions rules, a compliance officer and quarterly reports to the government until 2028 (UNC)
- Ending DEI programmes and reporting admissions data to the government (University of Virginia)
Harvard instead fought the administration in court and won back research funding, but the government’s appeal is pending.
